"Take-Two Interactive Software, Inc. (NASDAQ: TTWO) announced today that the Entertainment Software Rating Board (ESRB) has changed the rating of Grand Theft Auto: San Andreas on all platforms from "Mature 17+" (M) to "Adults Only 18+" (AO) because of the so-called "hot coffee mod," an unauthorized third party modification that alters the retail version of the game. Take-Two cooperated fully with the ESRB's investigation.
Rockstar Games will be making available shortly a downloadable software patch to render Grand Theft Auto: San Andreas for PC impervious to the "hot coffee" modification. Rockstar encourages parent groups and political leaders to assist with distribution of the patch to prevent the content of the modification from spreading further"
In a 5-0 ruling that characterized Take-Two and Rockstar's content claims as "deceptive," the Federal Trade Commission has offered its final ruling on the Hot Coffee incident from late last year.
Though it failed to levy monetary fines beyond the $24.5 million (£13.2 million) it noted was spent by Take-Two on the recall and re-issue of San Andreas subsequent to the content's discovery, the ruling made explicit that any further infractions by either company, including non-disclosure of relevant content, misrepresentation of content for a lower rating, or otherwise sidestepping established practices which ensure all content is considered when delivered to a ratings board will be met with an $11,000 (£5900) fine per infraction.
Take-Two president Paul Eibeler has responded to the ruling saying he was pleased with the outcome and looks forward to putting the matter behind him.
