I seem to be having a tons of issues with the PM system. ALL of the PMs I have previously sent are DELETED from the Sent Box... and now when I send a new PM, it stays in the outbox and never moves to the Sent Box.
Ok, fair enough... but why are messages that I know have been read by the reciever been deleted from my sent box? These are messages that at one time were in the sent box... but have disappeared.
Like any responsible company or community for that matter, we ensure the safety of customers and users.
Monitoring of private messages and any other internal communication on an online community is common place in any social network (like facebook, myspace etc). If this is not the case then the system is open to abuse and potential illegal, offensive or otherwise unacceptable material goes unnoticed.
Private Messages are strategically monitored or flagged for abuse automatically and are not routinely read by a member of community staff.
Sir, in response to the post you made on Mon Dec 03, 2007 at 12:55 am GMT (Server Time) under the username turck_mm from the IP address 130.126.38.236 we are pleased that you have read our Community Rules and we also recommend that you read the Terms of Service and our Privacy Policy.
In regards to the statement you made:

Big brother is watching you-- they monitor your PMs here. Just read the Community Rules.
Yes we do monitor any personal communications sent through the iVirtua system this is for the security of our members and to make sure that no one abuses the system. This task is operated through the third party organisation ISSEEE Security Systems along with security algorithms created by our in-house development team.
We recommend that if you want to truly have a private conversation you register a domain name, set up an email address and then use a downloadable software client like Mozilla Thunderbird to send out emails. If your emails contain confidential content we recommend you purchase email encryption software or use an open source alternative. You could also use a web based email service, like Yahoo! Windows Live Mail (formally Hotmail) or Gmail but this is seen as a less secure way to send emails.
We hope this helps you and other members of the iVirtua Community.
However Sir this gives me the opportunity to bring up your recent attempt to spam members of the iVirtua Community by sending Private Messages (PM's) of the Mac wikipedia article to our members. Thankfully our SPAM ISSEEE Software detected this and removed the Spam.
We decided to be lenient in this case and give you another chance to redeem yourself. However if you do this again action will be taken and as we state in the Community Rules and Terms of Service (CR & ToS)
CR & ToS wrote:
Violation of these rules will result in immediate warning and appropriate action including banning of Emails and Usernames and IPs, or reporting of IPs/Emails. We operate a 3 strike Yellow Card system.
If anything you contribute contains content that breaks any law, it is in violation of these conditions and the iVirtua Community Terms of Service and Community Rules will be edited or deleted. If serious enough, the violation of this rule will be reported to the appropriate legal authority and/or the member's ISP will be contacted.
If you have any other questions about this we ask you to contact us via the contact page.
We hope you have a pleasant Christmas and wish you a Happy New Year.
Sir, I am not too sure as to how to reply to your first statement, implying that I am big headed. I would have thought that someone with your maturity would leave personal insults alone in this situation, clearly I was wrong.
For your information on Mon Dec 03,2007 4:22 I was heading home from University, which I travel to and from each day, via Virgin Trains.
The IP you gave belongs to Mistral Internet Group Limited oh whom I have no connection. My IP address is owned by BT Internet.
Moving on to your second point, and I quote:

Did you know that in the US, you can be sent to jail for reading other people's mail?
Our servers are operated in the United Kingdom (to be more specific Guildford and mirrored in Reading)therefore US laws to do not apply to iVirtua Community UK.
We are protected and are allowed to carry out checks on Private Messages under the following legislation. I consulted our Legal Dept. and Sam England on this matter who provided me with this list.
The Interception of Communications Act 1985
Computer Misuse Act 1990
Data Protection Act 1998
Electronic Communications Bill 2000
The Data Protection (Processing of Sensitive Personal Data) Order 2000
The Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations (LBPR) 2000
The Information Commissioner’s Employment Practices
Data Protection Code. Section 3. Monitoring at Work
Communications Act 2003
People-related Laws
Obscene Publications Act 1959
Public Order Act 1986
Defamation Act 1996
Human Rights Act 1998
Malicious Communications Act 1988
Criminal Justice Act 1988
The Crime and Disorder Act 1998
Freedom of Information Act 2000
Sexual Offences Act 2003
Employment-related Laws & Regulations
Regulation of Investigatory Powers Act 2000
The Employment Equality (Sexual Orientation) Regulations 2003
The Employment Equality (Religion or Belief) Regulations 2003
Prevention from Harassment Act 1997
Employment Relations Act 2004 and the UK Employment Equality Act 2006.
Email messages that contain illegal/pornographic content may also contravene The Obscene Publications Act 1959, the Protection of Children Act 1978 and/or The Criminal Justice Act 1988.
We are also allowed to carry out the checking of Private Messages (classed as emails) under many EU laws and regulations, too many in fact to list here, however if requested I would be more that happy to send you the complete list of laws, regulations, acts and orders.
As of course privacy is a major concern to users of the Internet we follow the laws set in place by the Data Protection Act 1998 which states:
Data Protection Act 1998 wrote:
The Data Protection Act does not prevent an employer from monitoring its employees’ Internet and e-mail use. It simply requires that such monitoring is carried out fairly, lawfully and in a manner consistent with Article 8 of the European Convention on Human Rights, which creates a right to respect for private and family life and for correspondence.
Broadly speaking, the Act requires that any adverse impact on workers is justified by the benefits to the employer and others.
Equally, in some circumstances, monitoring Internet and e-mail use may be an important component in protecting systems processing personal information from damage or unauthorized access (e.g. scanning e-mails for worms and viruses).
Securing personal information from loss, damage and unauthorized use and disclosure is an important part of compliance with the Data Protection Act.
Part 3 of the Information Commissioner’s Employment Practices Data Protection Code‘Monitoring at Work’ is an authoritative source of guidance in this area.

It's not just wrong, it's immoral. I never read PMs other than my own.
Those are your own views and not those of everyone who is a member here and uses the private messaging system. And what you do on your own website is up to you.
In response to your next statement, andI quote:

You'vegiven me a reply that shows just how insecure you are. I point outone small facet of your rules, and this in turn warrants a long, defensive post from you?
No Sir I am not insecure I am only informing you and the other members of the community who will be reading this topic why we monitor Private Messages sent through the system. It could be said of you that you are simply trying to create an argument between myself and you, as you have already read the Terms of Service and Community Rules you know in fact that this is breaking the ToS and CR.
In response to your next statement, and I quote:
turck_mm wrote:
Not only that, you feel the need to insult me by suggesting I 'register a domain name' like you don't know that my domain name and web site are twice as old as this one.
The information that I gave out regarding how to send secure emails to people was not intended for you, it was intended for any other member of the community who may not be aware of the correct procedure to truly have a private email conversation online.
And finally in response to your last question, and I quote:

Btw, has iVirtua released any new features lately? I just released Profiles v2at MGC just half an hour ago and MGC itself a month ago.
iVirtua is currently in it's fourth state, which we are very proud of. We have two forms of development on the website, the first is continual development, where the development team focus on member feedback and fix any minor issues as well as creating new features that are required urgently. We are now currently at Version 4.9.2.1 with the most recent updates being a memcache upgrade and a colleague API update. Our second form of development are system upgrades were large changes are made to the look and feel of the website, as you may be aware we have been developing iVirtua 5 for the past year now and hope to have it launched sometime late next year, we are currently not giving out dates. I cannot disclose details about web technologies and frameworks being developed but be assured that when we move to v5major changes will be made to the iVirtua Community.
If you have any other questions that you need answering please visit the contact page or alternatively contact me directly through the Private Message system.
Master Finnigan. Quite clearly, the above "Quoted" message has been written by an individual posing as myself, as I am not an active participant nor member of your website. Having taken in to account and considered your previous actions however, it would be reasonable to conclude that it is in fact yourself that wrote that, alongside countless other attempts by yourself, including but not limited to perpetrating other online aliases and quite frankly causing a stir when there need not be.
Could I put you in touch with the following UK laws, which I believe you are breaking:
Quote:
Fraud Act 2006 (c.35)
Fraud by false representation (1) A person is in breach of this section if he— (2) dishonestly makes a false representation, and (3) intends, by making the representation— (4) to make a gain for himself or another, or (5) to cause loss to another or to expose another to a risk of loss.
David, I all I can say is that I am the one with the clear conscience and you seem to have issues that need rectifying.
