The notorious rapidshare.com among many "warez" groups is dead. It is suspected that the servers have been confiscated and so anyone with accounts and files stored will probably loose them.
"As of 19 January 2008 16:00 GMT, Rapidshare AG's servers were shutdown by anti-piracy authorities in Germany. More than hundreds of Rapidshare servers were seized from their offices in Berlin although no arrests were made. Sources said, authorities are contemplating pursuing legal action against users who distribute and download pirated copies of software and movies from these servers."

News is changing:

On 19 January 2007, news broke that German collections agency GEMA hadclaimed to have won a temporary injunction against both RapidShare.deand RapidShare.com. “The latter is said to have used copyrightprotected works of GEMA members in an unlawful fashion,”.[4] To dateRapidShare has claimed not to have any knowledge of the contentuploaded by the users and of not being in a position to control thecontent. Through its injunctions the District Court in Cologne had nowhowever made it clear to the company that the fact that it was theusers and not the operator of the services that uploaded the contentonto the sites did not, from a legal point of view, lessen theoperator’s liability for copyright infringements that occurred withinthe context of the services, the spokesman added. Currently rapidshareis not working.

The German collecting society GEMAhas obtained from the District Court in Cologne temporary injunctionsagainst the operator of the data exchange services www.rapidshare.deand www.rapidshare.com. The latter is said to have used copyrightprotected works of GEMA members in an unlawful fashion. The servicesmake virtual storage space available into which users can uploadcontent that is thereby made publicly available to other users. GEMAspokesman Hans-Herwig Geyer told heise online that the services shouldnot be allowed to continue to operate in their present form. Thecollecting society is now demanding that the operator provide detailson how many copyright protected works of GEMA members are currentlystored on the said sites. <cadv></cadv>

<!--OAS AD="Middle1"--><!-- heise blocker @page&@position -->

According to GEMA, the service www.rapidshare.de in particular hasat times boasted of making some 15 million files available to itsusers. The operator had however failed to obtain from GEMA a licensefor making copyright protected files available, the collecting societyspokesman observed. To date RapidShare had claimed not to have anyknowledge of the content uploaded by the users and of not being in aposition to control the same, the spokesman continued. Through itsinjunctions the District Court in Cologne had now however made it clearto the company that the fact that it was the users and not the operatorof the services that uploaded the content onto the sites did not, froma legal point of view, lessen the operator’s liability for copyrightinfringements that occurred within the context of the services, thespokesman added.
Harald Heker, the chairman of the executive board of GEMA, believesthe court's decisions will have repercussions on the way "Web 2.0services" such as YouTube and MySpace will be treated in future. Whatthe decisions according to Mr. Heker show is that "the merecircumstance of shifting acts of use to users and the purportedinability of the operator to control content do not relieve theoperator of a service from the copyright liability he/she/it possessesfor the content made available for download from the operator'swebsite(s)."
